Accident Abroad Claims

Whether you or a loved one is travelling abroad due to work or for pleasure, accidents can unfortunately occur.

Due to their nature, these accidents abroad can be very traumatic for those involved, their family and friends.

However, there are laws in place to protect you, should an accident occur that was not your fault.

Also, depending on the country where the accident occurred, reciprocal provisions may enable us to sue in the UK on your behalf but the law of the country you were in will apply.

You may also have a right of action against the travel agent who organised your trip as they will have owed you a duty of care to make the necessary checks when booking your trip.

You have the right to claim compensation for a non-fault accident abroad and our accident abroad solicitors can help make this happen as soon as possible.

Types of accidents abroad:

  • A road traffic accident where you were a driver, passenger or pedestrian
  • An accident on a ship or airplane
  • An accident in a hotel
  • A sporting accident
  • An incident that occurred whilst you were working abroad

You have the right to claim compensation for a non-fault accident abroad and our accident abroad solicitors can help make this happen as soon as possible.

Important Notes for Accident Abroad Claims

There are a few key points to bear in mind when deciding whether you are going to make a claim for an accident abroad:

  1. You may be able to sue in this country notwithstanding the incident that gives rise to the claim occurred abroad. This would normally be under reciprocal arrangements. We have such arrangements in the EC for example.
  2. Please bear in mind that although you may be able to instigate proceedings here the law applicable will normally be that applying in the country in which the incident took place.
  3. The limitation period (i.e. the period you have to sue after an incident) may be different in those countries.
  4. Please also bear in mind that if you want to pursue such a claim the rules may well change at the end of 2020 when our transitional arrangements with the EU come to an end.
  5. To protect yourself please contact us today and we will be able to help you.

Questions & answers

Am I entitled to make a claim?

In order to make a successful personal injury claim you must be able to prove that you suffered an injury as a result of someone else either doing something they should not have done, or not doing something they should have done.

This can often be complicated and our team will be able to fully advise you.
