Important Notes for Accident Abroad Claims

There are a few key points to bear in mind when deciding whether you are going to make a claim for an accident abroad:

  1. You may be able to sue in this country notwithstanding the incident that gives rise to the claim occurred abroad. This would normally be under reciprocal arrangements. We have such arrangements in the EC for example.
  2. Please bear in mind that although you may be able to instigate proceedings here the law applicable will normally be that applying in the country in which the incident took place.
  3. The limitation period (i.e. the period you have to sue after an incident) may be different in those countries.
  4. Please also bear in mind that if you want to pursue such a claim the rules may well change at the end of 2020 when our transitional arrangements with the EU come to an end.
